These terms are the agreement between you and Cyphagenics Limited (“we”, “us”). They cover the cyphagenics.io website and the Cybertoids game. By using either, you accept them. If you do not accept them, please do not use the service.
Nothing here takes away rights you have as a consumer under UK law. Where a term conflicts with your statutory rights, your statutory rights win.
About these terms
We may update these terms as Cybertoids develops. When we do, we will change the effective date at the top of this page, and for material changes we will give you reasonable notice in the app or by email before they take effect. Continuing to use the service after that means you accept the new terms.
Our Privacy Policy explains how we handle personal data and forms part of your agreement with us.
Who can use the service
You must be at least 13 to hold an account. If you are under 18, you need permission from a parent or guardian, and they are responsible for your use of the service and for any purchases you make.
Cybertoids is built to be played by families together. Younger children are welcome to play alongside an adult on that adult's account.
Your account
Give us accurate information when you register and keep it up to date. Keep your password to yourself — you are responsible for what happens on your account, unless someone uses it without your knowledge and it is not your fault.
Tell us at support@cyphagenics.io as soon as you think someone else has access to your account.
You can close your account at any time from Settings in the app. You can request closure at https://cyphagenics.io/delete-account; deletion is confirmed in the app. Closing it signs you out immediately and deletes your progress after a 30-day grace period. We cannot restore it afterwards.
Your licence to use the game
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play Cybertoids on devices you own or control, for your own non-commercial use. That is a licence, not a sale — we keep ownership of the game.
You may not:
- Copy, sell, rent, sub-licence or redistribute the game or any part of it.
- Reverse engineer, decompile or disassemble it, except where the law expressly allows it.
- Remove or obscure any copyright, trade mark or other proprietary notice.
- Use cheats, bots, modified clients or automation to gain an unfair advantage.
- Extract or scrape game content or data for use in another product, including to train machine learning models.
Acceptable use
Cybertoids is a family-friendly space and we intend to keep it that way. When using any social or community feature, do not:
- Harass, bully, threaten or impersonate anyone.
- Post content that is unlawful, hateful, sexual, or otherwise inappropriate for a family audience.
- Share anyone's personal information, including your own.
- Disrupt the service, probe it for vulnerabilities without permission, or interfere with other players' access.
- Use the service for anything illegal.
If you break these rules we may remove content, restrict features, or suspend or close your account. We will act proportionately and, where we reasonably can, tell you why and give you a way to respond.
Content you create
You keep ownership of anything you create or submit through the service — display names, messages, and any other content.
By submitting it, you give us a worldwide, royalty-free licence to host, store, reproduce and display that content solely to operate, promote and improve the service. The licence ends when you delete the content, except for copies in backups and where we must keep it by law.
You confirm you have the right to submit what you submit, and that it does not infringe anyone else's rights.
Purchases and virtual items
If the game offers paid content, purchases are made through the App Store or Google Play, and their payment terms and refund policies apply. We do not process or store your card details.
Virtual items and in-game currency are a licence to use them inside the game. They have no monetary value, cannot be exchanged for real money, and cannot be transferred outside the game. If your account is closed, any unused virtual items are lost.
For digital content bought directly from us, you have a legal right to cancel within 14 days — but that right ends once download or streaming begins with your agreement, and you acknowledge you lose it at that point. This does not affect your right to a repair, replacement or refund if the content is faulty or not as described.
Availability and changes to the game
Cybertoids is a live service. We may add, change or remove features, run maintenance, and release updates. We aim to keep the service available but we do not promise it will be uninterrupted or error-free.
If we ever decide to shut the service down permanently, we will give you at least 30 days' notice where we reasonably can, and refund any unused paid content you bought directly from us.
Our intellectual property
Cyphagenics, Cybertoids, the CyberToids characters, the Cybersphere setting, and all related artwork, audio, text, code and branding are owned by us or licensed to us, and protected by intellectual property law.
These terms give you no rights in our branding. You may not use our names or logos without written permission, except to refer to the game fairly and accurately.
App stores
You download the game through Apple's App Store or Google Play, and their terms apply alongside ours. Where their rules conflict with ours, theirs take precedence for that download.
This agreement is between you and us, not with Apple or Google. They are not responsible for the game, for supporting it, or for any claim about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Support requests should come to us at support@cyphagenics.io, not to Apple or Google.
Our responsibility to you
We do not limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit.
Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses — the service is provided for personal use only.
Apart from liability we cannot limit, our total liability to you in connection with the service is capped at the greater of the amount you paid us in the 12 months before the claim, or £100.
The game teaches cyber security concepts for education and entertainment. It is not professional security advice, and we are not responsible for decisions you make about real systems based on playing it.
Ending this agreement
You can end it at any time by deleting your account and uninstalling the game.
We can suspend or end your access if you seriously or repeatedly break these terms, or if we are required to by law. Where it is proportionate to do so, we will warn you first and give you a chance to put things right.
Sections that by their nature should survive — intellectual property, liability, and governing law — continue to apply after the agreement ends.
General
If any part of these terms turns out to be unenforceable, the rest stays in force. If we do not enforce a term straight away, we have not given up the right to enforce it later.
You may not transfer your rights under these terms to anyone else. We may transfer ours to a company that takes over our business, and we will tell you if we do.
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EEA, you keep the protection of the mandatory consumer law of the country you live in and can bring proceedings there.
